What Does a Migration Lawyer Do?

A migration lawyer is a solicitor admitted to practise law in Australia who also advises on the Migration Act 1958 and Migration Regulations. Because they hold a current Australian practising certificate, a migration lawyer can prepare and lodge visa applications and, importantly, represent you in the Administrative Review Tribunal (ART) or the Federal Circuit and Family Court if a decision needs to be reviewed or appealed. This is something a registered migration agent is not permitted to do. Oceanic Legal & Migration Services combines migration law with family law, conveyancing and commercial law experience, so complex matters that touch more than one area of law can be handled under one roof.

Migration Lawyer Adelaide

Frequently Asked Questions

Do I need a migration lawyer or can I apply for a visa myself?

You can apply for most visas yourself. A migration lawyer reduces the risk of refusal due to incomplete or poorly presented evidence, and, unlike a migration agent, can also represent you at the Administrative Review Tribunal or in court if your application is refused.

What's the difference between a migration lawyer and a registered migration agent?

Migration lawyers are solicitors regulated by their state Law Society (in our case, the Law Society of South Australia) and can represent clients at the Administrative Review Tribunal and in court. Registered migration agents are regulated by a separate scheme and cannot appear in court.

How much does a migration lawyer cost?

Costs depend on your visa category and how complex your matter is. We'll give you a clear, tailored quote after discussing your situation in an initial consultation. See our pricing page for general information, or contact us for details.

Can you help if my visa has already been refused?

Yes. We assist with internal reviews and Administrative Review Tribunal appeals. These carry strict time limits, so contact us as soon as possible after receiving a refusal or cancellation notice.

Do you offer consultations for clients outside Adelaide?

Yes. We act for clients across South Australia and internationally via phone and video consultation, and Oceanic Legal & Migration Services also maintains offices in India and Dubai.

How long does a visa application take to process?

Processing times vary significantly by visa subclass and are set by the Department of Home Affairs, not by us. We'll give you a realistic estimate for your specific visa during your consultation.
